II.TERMS OF USE

1. PURPOSE OF THE TERMS OF USE

Access to the Site and use of its content are subject to these Terms of Use (hereinafter the “Terms of Use”).

The purpose of these Terms of Use is to set forth the terms and conditions for using the Site, as well as the rights and obligations of any user who accesses, browses, or visits the Site (hereinafter the “User” or “Users”).

By accessing the Site, the User agrees during each visit to comply with these Terms of Use, which apply to all services available on the Site.

Accordingly, the User unconditionally accepts these Terms of Use in their entirety prior to any use of the Site. If this is not the case, the User agrees not to use the Site.

The processing of Users’ personal data in connection with their registration and participation in the Journées Particulières is described in the Personal Data Processing Notice for the Journées Particulières, which is available on the Platform.

LVMH reserves the right to update or modify the information and content on the Site, including these Terms of Use, at any time and without prior notice. Any changes take effect upon their publication. These changes are deemed to have been accepted unconditionally by all Users who access them after they have been posted online. To stay informed of any such changes, Users are advised to regularly review the latest version of the Terms of Use available on the Site. However, Users will be notified of any substantial changes to the Terms of Use.

2. PLATFORM ACCESS AND REGISTRATION REQUIREMENTS

Access to the Site is free. The User is responsible for the costs of accessing and using the telecommunications network in accordance with the terms and conditions set out by their Internet and telecommunications service providers.

Registration and reservations are limited to persons of legal age. Only persons of legal age may make a reservation for the Journées Particulières. Any attempt by a minor to make a reservation will be rejected.

If one or more accompanying persons are minors, the User certifies that they are the legal guardian of said minor(s) and/or has obtained the express authorization from their legal guardians to make this reservation.

Users requiring special access to facilities or services (mobility-impaired persons) are asked to indicate this in the field provided for this purpose when registering so that the relevant Maison can make the necessary arrangements.

Geographic Availability of the Service

The reservation platform is available worldwide, except in China.

3. INTELLECTUAL PROPERTY

The entire Site is governed by international law regarding copyrights, trademarks and, more generally, intellectual property, both in terms of its form (selection, structure, arrangement of content, means of accessing data, databases, or any organization of data, etc.) and each element of its content (brands, text, images, videos, etc.). The content appearing on Site's pages is the exclusive property of LVMH and its contributors, who grant the User no license or any right other than the right to visit the Site.

The reproduction of any content published on the Site is permitted solely for informational purposes and for personal and private use. Any reproduction, retrieval, and/or use of content for other purposes is expressly prohibited and may result in the user facing civil and criminal liability.

Hyperlinks to any of the Site's pages or elements may only be created with LVMH’s prior written authorization. This authorization may be revoked at any time. Websites containing a hyperlink to the Site or any of its elements are not under the control of LVMH; in consequence, LVMH disclaims all liability (including editorial liability) regarding access to and the content of such websites.

The Site may include links to other websites or online sources. Insofar as LVMH has no control over these external sites and sources, LVMH cannot be held liable for the availability of these external sites and sources, and disclaims all liability regarding the content, advertisements, products, services, or any other information or data available on or via these external sites or sources. Furthermore, LVMH cannot be held liable for any actual or alleged damages or losses arising out of or in connection with the use of or reliance on the content, goods or services available on these websites or external sources.

4. USER OBLIGATIONS AND LIABILITY

The User agrees not to:

• use or allow the Site to be used in an abusive manner or for illegal, fraudulent or malicious purposes, including, but not limited to: (i) hacking the Site or introducing malicious code, including viruses or harmful data, into the Site or any operating system, (ii) using a web crawler or any other system, device or program (automated or otherwise) to retrieve data or information from the Site or LVMH’s servers, (iii) sending or storing documents containing viruses, worms, Trojan horses, or other malicious code, files, scripts, agents or malicious computer programs, (iv) interfering with or compromising the integrity or performance of the Site and the data it contains, (v) attempting to gain unauthorized access to the Site, its systems or associated networks, and (vi) attempting to gain unauthorized access to other Users’ accounts or personal information
• use the Site under conditions other than those set forth in these Terms of Use, or under conditions that infringe upon the intellectual property rights of LVMH and its contributors or harm LVMH’s reputation
• use the Site in any way that could damage, disable, overburden, disrupt, or compromise the operation or security of the Site

The User acknowledges that they are solely responsible for their use of the Site and the consequences of such use.

The User must keep their username and password strictly confidential. Under no circumstances may the User disclose this information to a third party so as to allow them access to the Site. The User is solely responsible for all activities undertaken through their user account, including those carried out by any unauthorized user.

5. LVMH'S LIABILITY

LVMH makes every effort possible to ensure that the information published on the Site is accurate and up to date. LVMH reserves the right to correct this information at any time and without notice.

To the fullest extent permitted by applicable law, LVMH cannot be liable for:

• any imprecision, inaccuracy, or omission regarding the information available on the Site, or
• any damages resulting from a third-party intrusion that has either altered the information made available on the Site or made it impossible to access the Site

6. AVAILABILITY – MAINTENANCE

LVMH will make its best effort to maintain a reasonable level of operation and availability for the Site. LVMH reserves the right, at any time and without prior notice, to restrict a User’s access to and use of the Site in order to perform maintenance or make changes. LVMH cannot be held liable in the event of an interruption in access due to these maintenance or update operations.

7. PERSONAL DATA

LVMH is committed to protecting the personal data of the Site's Users. The processing of personal data carried out in connection with the Platform and the Journées Particulières is conducted in accordance with Regulation (EU) 2016/679 (GDPR) and Law No. 78-17 of January 6, 1978, as amended, known as the “French Data Protection Act.” To manage reservations and access to the Journées Particulières, LVMH collects the data necessary to identify Users, verify compliance with the terms and conditions for accessing the sites, and ensure the security of the event.

LVMH invites Site Users to review the Personal Data Processing Notice for the Journées Particulières available on the Platform, which specifies, among other things, the processing activities carried out, their legal bases, the storage periods, and the data recipients.

In accordance with the applicable regulations, the User has the right of access to their personal data and the right to rectification, erasure, restriction of processing, data portability, and to object to the processing of their personal data. The Platform may use cookies and trackers. The procedures for managing these cookies are outlined in the dedicated policy available on the Platform.

8. GOVERNING LAW – JURISDICTION

These Terms of Use are governed by French law.

Any disputes arising from these Terms of Use shall be subject to the exclusive jurisdiction of the French courts.

9. LANGUAGE

These Terms of Use are written in French. They may be translated into English and Italian. In the event of any discrepancy in interpretation, only the French text shall be considered valid.
